Terms
Draft — not yet legally reviewed.
This is a draft. It describes what the software actually does and what the operator intends,
written so a lawyer has something real to correct. Every point that needs a legal decision is
marked [LEGAL: …]. Do not rely on it until those marks are gone.
1. Who you are contracting with
SlongeHoops is operated by Slonge Solutions Tobler, Switzerland. “We” and “us” mean that operator. “You” means the person using the service.
[LEGAL: the contracting entity needs its legal form, registered address and register number here, and it has to be the same entity that appears on the receipts and in the imprint.]
One thing has to be said at the top. When you buy a subscription, your contract for that
purchase is with Stripe, not with us. Stripe Managed Payments is the seller on record — the
merchant of record. Your statement will read LINK.COM*. Stripe’s own terms govern the sale,
the tax and the refund. Our terms govern the software.
[LEGAL: this split has to be stated correctly, because it decides who owes the consumer what. Confirm the wording against Stripe’s Managed Payments terms and confirm which Stripe entity is the seller for a Swiss operator.]
2. What the service is
SlongeHoops is a browser application for drawing basketball plays, watching them run, storing them in playbooks, sharing them and exporting them.
What it is not, stated so nobody is surprised:
- It does not predict outcomes. The simulated defense never decides whether a shot goes in, whether a pass is stolen, or whether a play works. It shows where five defenders end up according to rules and the settings you chose.
- The simulated defense is in Beta. It is rule-based and deterministic. It may put a defender somewhere a coach would not. Do not treat it as a scouting report.
- It does not import or edit video, and it does not read a photograph of a hand-drawn diagram.
- It gives no coaching, medical, safety or officiating advice. Rules differ between FIBA, NFHS, NCAA and NBA competition, and between youth federations. Check your own rule book.
3. Accounts
You may use the editor, the library, playback and sharing without an account, in which case your plays stay in your browser and we hold nothing.
With an account, you are responsible for what happens under it. Tell us if you think somebody else has access.
Age. [LEGAL: a minimum age has to be set, and it has to work in every country the service is offered in. Today there is none, no age is asked for, and there is no parental-consent flow. This is the same open item as in the privacy policy and it blocks a public launch.]
Players and invited members. A player can join a team with an invite code and a display name, without an e-mail address. A coach who invites players is responsible for having the right to add them and for what they enter about them.
[LEGAL: whether a club or a coach can bind a minor to these terms, and what the coach warrants when adding a roster entry, needs drafting properly.]
4. What you own, and what we own
Your plays are yours. Anything you draw, write in a coaching note, name or organise into a playbook belongs to you. We do not claim ownership of it and we do not use it to train anything. You can export all of it at any time as a file you keep.
We need a narrow permission to run the service: to store your content, show it to the people you share it with, and process it as you ask — for example sending a play’s text to the AI quiz writer when you press that button. Nothing beyond that.
[LEGAL: this licence grant has to be written properly — scope, sublicensing to sub-processors, duration, and what survives deletion.]
The library is ours. The built-in plays, action templates, descriptions and coaching notes were drawn and written for this product. Basketball concepts are not ours and nobody owns them — you may run any of these sets with your team, obviously. What is ours is the particular diagrams and the particular words.
[LEGAL: decide the licence for the built-in library. A coach copying a built-in play into their own playbook and editing it is the intended use and is allowed. Redistributing the library as a collection is not. This needs stating.]
[LEGAL: ten plays in the library were converted from sets described in a third party’s newsletter, with the source recorded in the data. Their status has to be settled with that author, or those ten replaced, before the library is sold as part of a paid product.]
Your team’s name, your club’s name and your players’ names are yours. We do not use them in marketing, ever.
5. Acceptable use
Do not:
- upload or write anything unlawful, abusive, or that identifies a child beyond a name on a roster;
- use the service to harass anybody, including through a share link or a quiz;
- attempt to reach data that is not yours, probe the security of the service, or use automated means to extract the library;
- resell access, or present the service as your own;
- circumvent the limits of the free tier. Some of them run in your browser and can be bypassed by anybody determined; doing so is still a breach of these terms.
We may suspend an account that does any of this. [LEGAL: the suspension and termination process needs notice periods, an appeal route, and what happens to the content of a suspended account.]
6. Plans and payment
| Plan | Price | What it is |
|---|---|---|
| Free | $0 | The editor, the isometric view, every court look, the whole built-in library, share links and the viewer, quizzes generated from a play, 720p video with a small watermark. Four saved plays. |
| Coach | $8 per month or $72 per year | Unlimited plays synced to your account, every simulated-defense setting with presets and A/B compare, 1080p video with no watermark and reel formats, the AI quiz writer at 30 a month, short share links. |
| Team | $15 per month or $144 per year | Everything in Coach, 3 coach seats, team quiz results, 100 AI quizzes a month for each coach, and control over what players can see. |
| Club | $39 per month or $390 per year | Everything in Team, 15 coach seats, up to 8 teams, club administrators, shared defense presets, 300 AI quizzes a month for each coach. |
Players and viewers never pay. Watching a shared play, taking a quiz and being on a roster are free on every plan and always will be.
Prices exclude VAT and sales tax. Stripe adds whatever applies to you at the checkout.
Trials. Coach starts with 14 days free and no card. Team and Club start with 30 days.
Renewal and cancellation. Subscriptions renew until cancelled. You can cancel at any time and keep access until the end of the period you paid for.
[LEGAL: the renewal notice requirements differ by country — some require a reminder before an annual renewal. Check at least Switzerland, Germany, France and the UK.]
Refunds. Stripe is the seller and may refund you within 60 days at its own discretion. Ask us first and we will try to sort it out; if we cannot, Stripe may do it anyway.
[LEGAL: the EU and UK consumer right of withdrawal — 14 days — applies to a digital service bought at a distance, and is normally waived expressly by the consumer when the service starts immediately. Whether Stripe collects that waiver at its checkout, or whether we have to, needs confirming. Swiss law has no equivalent general right, which makes the wording harder, not easier.]
Price changes. [LEGAL: state how much notice a price change gets and whether an existing annual subscription is protected until renewal.]
7. Availability, and what happens if this stops
We do not promise the service will always be available. It is built and run by one person.
Two things are true and worth knowing:
- Every play exports as a file you own, in a documented format.
- The app runs in your browser and works offline once loaded.
[LEGAL: decide whether to commit to anything on wind-down — for example a notice period and an export window if the service is discontinued. A commitment here would be worth more to a coach than any uptime number, and it is a real obligation.]
8. What we do not warrant, and what we are liable for
The service is provided as it is. We do not warrant that the simulated defense is correct, that a play will work, or that the service is fit for any particular competition or rule set.
[LEGAL: the entire limitation of liability and warranty disclaimer has to be drafted by a lawyer. Blanket exclusions are unenforceable against consumers in the EU, in the UK and in Switzerland, and a clause that is void is worse than one that is modest. Liability for death, personal injury and intent cannot be excluded anywhere.]
9. Law and disputes
[LEGAL: governing law and jurisdiction. A Swiss operator would normally choose Swiss law and its own courts, but a consumer in the EU keeps the protection of their own country’s mandatory law and usually the right to sue at home, whatever the clause says. Draft it so it is not misleading, and add the EU online dispute resolution information if it still applies.]
10. Changes to these terms
If we change these terms in a way that matters, we will say so in the app and update the date at the top.
[LEGAL: decide the notice period for a material change and whether a user may terminate on notice of one.]
